A reader from Sharjah asks: I am an interior designer and have had residence status for a year. I have just resigned from my company, I am transferring to an interior design outfit as a project manager. My contract with my previous employer is open-ended.

Is my job category exempt from the ban? Can I pay a fee to lift the ban? Is my previous employer obliged to issue an NOC if there is a request for a transfer from my present employer?

I would like to confirm that the Ministry of Labour applies the ban automatically upon every cancellation transaction no matter what the category of profession.

However, whereas the questioner has completed a period of one year's service for his employer; which is the minimum period fixed by the Ministry of Labour in cases of visa transfer, then the questioner may submit an application with the Ministry of Labour seeking an exemption from the NOC condition in order to transfer to a new employer and he may attach to his application copies of his certificates and merits.
