| | | | Access to and use of this site (fnews.com, the "Site") is provided by Al Nisr Publishing LLC and/or Al Nisr Media FZ LLC (the "Owners"), subject to the following terms:
1. By using the Site you agree to be legally bound by these terms, which shall take effect immediately on your first use of the Site. If you do not agree to be legally bound by all the following terms you may not access and/or use the Site.
2. The Owners may change these terms at any time by posting changes online. Please review these terms regularly to ensure you are aware of any changes made by the Owners. Your continued use of the Site after changes are posted means you agree to be legally bound by these terms as updated and/or amended.
Use of the Site
3. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use the Site content in any way except for your own personal, non-commercial use. You also agree not to adapt, alter or create a derivative work from the Site content except for your own personal, non-commercial use. Any other use of the Site content requires the prior written permission of the Owners. If the Owners have granted a specific license to you, you may copy or reproduce Site content if such copying or reproduction is incidental or necessitated by your legitimate business needs, strictly subject to the requirement that all Content is properly accredited to the Owners.
4. You agree to use the Site only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of the Site. Prohibited behaviour includes but is not limited to harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content or disrupting the normal flow of dialogue within the Site.
5. In accessing the Site you agree not to:
(a) impersonate another person or use a false name or a name you are unauthorised to use to create a false identity or e-mail address or try to mislead others as to the identity or origins of any communications;
(b) damage, interfere with or disrupt access to the Site or to anything which may interrupt or impair its functionality;
(c) threaten, harass, stop, abuse, disrupt or otherwise violate the rights (including rights of privacy and publicity) of others; or
(d) make available, upload or distribute by any means any material or files that contain any viruses, bugs, corrupt data, "trojan horses", "worms" or any other harmful software.
The Owners retain the absolute right to prevent you from accessing the Site, without prejudice to any of the Owners’ accrued rights, where we in our absolute discretion consider that you are contravening these terms and conditions and/or any other access policy we may maintain.
Disclaimers and Limitation of Liability
6. The Site content, including the information, names, images, pictures, logos and icons regarding or relating to the Owners, their products and/or services (or to third party products and services), is provided "AS IS" and on an "IS AVAILABLE" basis without any representations or any kind of warranty made (whether express or implied by law), including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
7. Under no circumstances will the Owners be liable for any of the following losses or damage (whether such losses were foreseen, foreseeable, known or otherwise):
(a) loss of data;
(b) loss of revenue or anticipated profits;
(c) loss of business;
(d) loss of opportunity;
(e) loss of goodwill or injury to reputation;
(f) losses suffered by third parties; or
(g) any indirect, consequential, special or exemplary damages arising from the use of the Site regardless of the form of action.
In any other event, our liability shall be limited to AED 100 per event.
8. The Owners do not warrant that functions contained in the Site content will be uninterrupted or error free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses, bugs, corrupt data, "trojan horses", "worms" or any other harmful software.
9. The Owners reserve the right to modify or suspend the Site at any time and for so long as the Owners (at their sole discretion) may wish.
10. The Site may from time to time contain links to other internet websites. The Owners are not responsible for the content of external internet sites.
Intellectual Property
11. The names, images and logos identifying the Owners or third parties and their products and services are subject to copyright, design rights and trademarks of the Owners and/or third parties. Nothing contained in these terms shall be construed as conferring by implication, estoppel or otherwise any license or right to use any trademark, patent, design right or copyright of the Owners or any other third party.
Contributions to the Site
12. Where you are invited to submit any contribution to the Site (including any text, photographs or graphics) you agree, by submitting your contribution, to grant the Owners a perpetual, royalty-free, non-exclusive, sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to your contribution worldwide and/or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution. If you do not want to grant to the Owners the rights set out above, you must not submit your contribution to the Site.
13. By submitting your contribution to the Site, you:
13.1 warrant that your contribution:
13.1.1 is your own original work and that you have the right to make it available to the Owners for all the purposes specified above;
13.1.2 is not defamatory;
13.1.3 will not cause harm; and
13.1.4 does not infringe any law;
13.2 indemnify the Owners against all legal fees, damages and other expenses that may be incurred by the Owners as a result of your breach of the above warranty or otherwise; and
13.3 waive any moral rights in your contribution for the purposes of its submission to and publication on the Site and the purposes specified above.
General
14. If there is any conflict between these terms and specific terms appearing elsewhere on the Site (including the Site house rules) then these terms shall prevail.
15. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.
16. These terms shall be governed by and interpreted in accordance with the laws of the United Arab Emirates applicable in the Emirate of Dubai. | |
