Dubai: A man has been jailed for raping and sexually abusing a mentally disabled woman, while her housemaid has been found not guilty of allowing him to molest her.

Forensic doctors who examined the 26-year-old disabled woman confirmed there were no signs of recent sexual intercourse but didn't dismiss the fact that she could have been molested.

The Dubai Court of First Instance sentenced the 39-year-old, S.Y., to five years in jail but acquitted the 33-year-old housemaid, J.B., of aiding and abetting S.Y. for uncorroborated evidence.

The accused, who is an expatriate, will be deported after serving his punishment.

J.B.'s lawyer Ali Musabbeh, of Salem Al Sha'ali and Co Advocates and Legal Consultants, argued in his defence: "My client didn't assist the accused in carrying out his crime... the Public Prosecution based its charges upon the mentally disabled woman's statement and which came inconsistent and baseless."

Responsible for actions

Musabbeh argued that the psychologist, who examined the victim, stated before the court that the victim is sporadically responsible for her actions.

"I love you... I want to kiss you... I want to sleep with you," was what the victim cited the accused as telling her when she gave her statement.

Records said she saw the accused paying Dh100 or more following one of the molestations which happened in J.B.'s room.

"I am innocent ... I didn't give any hand to S.Y.," the housemaid told the court earlier.

The man pleaded innocent and said when he appeared in court: "I am not guilty... it didn't happen."

The Public Prosecution charged him with touching the girl's body, luring her into the housemaid's room where he forcefully undressed and raped her.

Meanwhile, J.B. was earlier charged with aiding and abetting S.Y. by playing the mediator's role and bringing the victim to her room.
